What do you expect to discuss during your panel: Litigation Trends for Litigators and Transactional Lawyers?

There is a great deal of strategy involved in cybersecurity and data security practice. This panel will address the most important litigation trends to better defend companies in litigation and for transactional lawyers seeking to avoid litigation. Among other things, this panel will address the current circuit split on standing and its implications for California companies, the type of claims that are raised in litigation and how courts view them, causation and class certification issues, and trends in cybersecurity settlements.

How will this discussion benefit practitioners?

Our panel is designed to benefit both litigators and transactional attorneys. The discussion will be useful to litigators who need to understand what the circuit splits are, what the causes of actions are, and what arguments courts are accepting and rejecting. On the transactional side, panelists will share practical and specific guidance on how to structure transactions to avoid litigation, including what preventative measures to take and how to craft enforceable arbitration provisions.

How will this panel discussion differ from other speaking events on this topic?

Cybersecurity events do not typically focus on litigation. This panel offers a unique opportunity to learn about the latest developments in cybersecurity litigation, exploring what the trends are and how to win cases. Unlike other events that tend to be quite broad, we will focus in a deep way on issues that most companies need to understand to avoid litigation.

Insights from the people who deal with security at the highest levels of a company is very beneficial to practitioners who want to understand the business and technology issues that are being addressed.

How will this panel discussion differ from other speaking events on this topic?

This is a very high-level group. We will have general counsel and chief information security officers from leading companies talking about the issues that are of concern to them. That offers information at a higher level than is often the case at other conferences.
